Judgment text excerpt

The Supreme Court ruled on the constitutional validity of the Uttar Pradesh Lokayukta and Up-Lokayuktas (Amendment) Act, 2012, which amended Section 5 of the Uttar Pradesh Lokayukta and Up-Lokayuktas Act, 1975, extending the term of Lokayukta from six to eight years. The Court held that the Amendment Act was ultra vires the Constitution as it retroactively affected the tenure of the incumbent Lokayukta, Mr. Justice N.K. Mehrotra, who had completed his term on 15.03.2012. Consequently, the writ petition under Article 32 was allowed, declaring the Amendment Act unconstitutional.
