The Supreme Court addressed the legality of the Kandla Port Trust's Resolution No. 108, which cancelled the tender process initiated in 2005 due to delays in obtaining Coastal Regulatory Zone (CRZ) clearance. The Court held that the Port Trust's decision was arbitrary and violated the principles of natural justice, as it failed to provide adequate reasons for cancellation and did not consider the legitimate expectations of the bidders. The Court ruled that the cancellation was invalid and directed the Port Trust to proceed with the allotment process as per the original terms.
