Judgment text excerpt

The Supreme Court upheld the dismissal of Writ Petitions Nos. 95 & 112 of 2003, challenging the transfer of cases under the Foreign Exchange Regulation Act, 1973 (FERA) to a Special Judge. The Court found that the State Government had the jurisdiction to authorize the Special Judge to try these cases, as per Section 56 of FERA. The Court affirmed that the transfer was valid and necessary due to the overlap of evidence and witnesses in the ongoing Fodder scam cases.
