Judgment text excerpt
The Supreme Court upheld the decision of the Punjab and Haryana High Court affirming the decree for specific performance of an agreement dated 19.7.1977 under Section 12 of the Punjab Land Reforms Act, 1972. The Court found that the respondent was ready and willing to perform his part of the agreement and that the objection regarding landholding limits was unfounded, as a prior decree for partition established the respondent's compliance with the law. The Court directed the respondents to pay the remaining amount of Rs.57,500/- with interest at 12% per annum, failing which the decree would be altered to refund the initial payment with interest.
