Judgment text excerpt
The Supreme Court ruled that the University Grants Commission (UGC) does possess the authority under Section 12(j) and Section 26(1) of the University Grants Commission Act, 1956 to establish final qualifying criteria for the National Eligibility Test (NET) results. The Court held that the UGC's power to fix aggregate marks as qualifying criteria is consistent with its mandate to maintain standards in higher education. Consequently, the judgment of the Bombay High Court, which found the UGC lacked such competence, was overturned, affirming the UGC's regulatory authority.
