The Supreme Court examined the legality of the amendment to the Master Plan of Delhi via Notification dated 20.9.1995, which allowed the use of land earmarked for Nursery Schools for other purposes, under the Delhi Development Authority Act, 1957. The Court held that the amendment was ultra vires the Act and arbitrary, thereby violating the constitutional provisions. Consequently, the allotment of land to respondent No.4 for a different purpose was deemed invalid, and the appeal was allowed, reversing the Delhi High Court's decision.
