The Supreme Court addressed the issue of the age of superannuation for government servants provisionally allocated to Bihar from Jharkhand under the Bihar Reorganisation Act, 2000. The Court held that personnel who attained the age of 58 years between 26.10.2004 and 23.03.2005 should not be treated as superannuated and are entitled to continue in service until the age of 60 years, as per the notification issued by the Central Government. The Court directed that these employees should receive their salaries for the intervening period until they reach the age of superannuation.
