Judgment text excerpt

The Supreme Court held that the appellant's application for a liquor bar license must be evaluated under the West Bengal Excise (Selection of New Sites and Grant of License for Retail Sale of Liquor and Certain Other Intoxicants) Rules, 2003, as amended, which impose a 1000 feet restriction from religious places and educational institutions. The Court found that the appellant's premises were within this prohibited distance from several religious sites, thus validating the High Court's decision to revoke the temporary license. The Court emphasized that the rules in effect at the time of the application are applicable, and the earlier 300 feet restriction under Rules, 1993 does not apply in this case.
