The Supreme Court upheld the conviction of Tofan Singh under Section 8(c) read with Section 21 and Section 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, affirming the High Court's dismissal of his appeal. The Court found that the prosecution had established the appellant's involvement in the trafficking of 5.250 Kgs of heroin, with sufficient evidence supporting the seizure and the appellant's role in the crime. The sentence of 10 years rigorous imprisonment and a fine of Rs. one lakh was deemed appropriate and was maintained by the Court.
