The Supreme Court upheld the order of the National Consumer Disputes Redressal Commission directing the Pariwar Co-operative Housing Society Ltd. to refund the amount paid by respondent No.1 along with interest at 9% per annum. The Court found that the Society was responsible for the non-allocation of the apartment and the non-refund of the amount, despite the Society's claim that the mismanagement was due to respondent No.2, the former Chief Promoter. The Court emphasized that the Society cannot evade liability for the actions of its representatives under the Consumer Protection Act, 1986.
