The Supreme Court addressed the appeals against the Gujarat High Court's judgment regarding the levy of market fees under the Gujarat Agricultural Produce Markets Act, 1963. The Court held that the Agricultural Produce Market Committee (APMC) was justified in levying market fees on castor seeds purchased within its market area, as the exemption under sub-rule (2) of Rule 48 of the Gujarat Agricultural Produce Market Rules, 1965 did not apply when the produce was sold within the market area. The Court upheld the High Court's decision to partly allow the APMC's application, affirming the legality of the market fee levy on castor seeds while also addressing the treatment of de-oiled cake.
