The Supreme Court addressed the conflict between the decisions in Bharat Damodar Kale v. State of Andhra Pradesh and Krishna Pillai v. T.A. Rajendran regarding the computation of limitation under Section 468 of the Code of Criminal Procedure, 1973. The Court held that the relevant date for computing limitation is the date of filing of the complaint, not the date of taking cognizance by the Magistrate. The matter was referred to a five-Judge Bench for an authoritative pronouncement on the correctness of the Krishna Pillai decision.
