Judgment text excerpt
The Supreme Court upheld the High Court's dismissal of the writ petition filed by Mumbai Waste Management Ltd. (MWM) challenging the reallocation of hazardous waste management areas by the Secretary of Environment, Government of India. The Court found that the 2008 Hazardous Waste (Management, Handling and Transboundary Movement) Rules did not strip the authority of the Secretary to modify territorial jurisdictions, as the petitioner failed to challenge the validity of these rules. The Court affirmed that the allocation of operational areas was within the jurisdiction of the government under the applicable rules.
