The Supreme Court ruled that the appellants, who served as Acting Child Development Project Officers (CDPOs) since July 1999, are entitled to the pay scale of the CDPO position as per the West Bengal Junior Welfare Services Rules. The Court emphasized that despite the lack of a specific recruitment rule for CDPOs, the appellants had been performing the duties of the post and thus should receive the corresponding salary. The Court directed the respondents to pay the appellants the salary in the prescribed scale from the date they began acting as CDPOs.
