The Supreme Court ruled that the appellants, who served as Acting Child Development Project Officers (CDPOs) since July 1999, are entitled to the pay scale of the CDPO position as per the West Bengal Junior Welfare Services Rules. The Court emphasized that the denial of appropriate pay for duties performed in an acting capacity is unjust and illegal under service law principles. The Court directed the respondents to pay the appellants the salary corresponding to the CDPO post from the date they began acting in that capacity.
