The Supreme Court set aside the High Court's order dated 28.12.2010, which contained adverse remarks against the appellant, on the grounds that the respondent-State had already settled the claim payable to the contesting respondent. The Court held that such strictures were unwarranted given the settlement, thereby allowing the appeal partly and expunging the remarks. The parties were directed to bear their own costs.
