The Supreme Court ruled that complaints filed under the Consumer Protection Act, 1986 are maintainable against final assessment orders under Section 126 of the Electricity Act, 2003. The Court clarified that consumers have the option to either file a complaint under the Consumer Protection Act or appeal under Section 127 of the Electricity Act. It was held that the jurisdiction of the Consumer Fora is not barred by the Electricity Act, as per Sections 173, 174, and 175, which preserve consumer rights under the Consumer Protection Act.
