Judgment text excerpt

The Supreme Court addressed the entitlement of a member of the Armed Forces to disability pension under Regulation 173 of the Pension Regulations for the Army, 1961. The Court held that the presumption of sound physical and mental condition upon entry into service is valid unless disabilities are recorded at that time. The Court upheld the Division Bench's decision to set aside the Single Judge's order granting disability pension, concluding that the appellant's condition was not attributable to military service as per the findings of the Medical Board.
