The Supreme Court upheld the High Court's ruling that the Uttar Pradesh Jal Nigam Employees (Retirement on attaining age of superannuation) Rules, 2005, which prescribed different retirement ages for the same class of employees, were discriminatory and unconstitutional under Article 14 of the Constitution. The Court affirmed that employees are entitled to retire at the age of 60 years and directed the payment of 20% back wages to those who were forced to retire at 58 years without interim relief. The ruling was limited to those who had filed writ petitions prior to their retirement.
