Judgment text excerpt

The Supreme Court addressed the conflict in opinions regarding the powers of the Session Court under Section 193 of the Code of Criminal Procedure, 1973. It was held that the Session Court cannot summon additional accused before reaching the stage indicated in Section 230, and must wait until Section 319 is invoked to include others in the trial. The Court referred the matter to a larger bench for resolution, thereby overruling the conflicting views expressed in previous judgments, particularly Ranjit Singh's case.
