The Supreme Court upheld the High Court's decision declaring the Uttar Pradesh Jal Nigam Employees (Retirement on attaining age of superannuation) Rules, 2005 unconstitutional under Article 14 of the Constitution, as it prescribed two different ages of retirement (58 and 60 years) for similarly situated employees. The Court held that such differentiation based on the source of entry into service is discriminatory and violates the principle of equality. The Court directed that employees should be allowed to continue until the age of 60 years and granted 20% back wages to those who were forced to retire at 58 without interim relief.
