Judgment text excerpt

The Supreme Court addressed the appeal against the Bombay High Court's refusal to stay the order of the District Deputy Registrar under Section 5A of the Maharashtra Ownership Flats (Regulation of the Promotion of Construction, Sale, Management and Transfer) Act, 1963. The Court held that the appellants, as legal heirs of the original landowner, could not unilaterally terminate the agreement with the cooperative society, and that the society had the locus standi to seek a unilateral conveyance deed. The Court affirmed the authority of the District Deputy Registrar to grant such certificates, thereby upholding the High Court's decision.
