Judgment text excerpt

The Supreme Court held that the High Court erred in quashing the prosecution proceedings under Sections 323, 348, 365, 368, 506 read with 34 and 120-B of the IPC, which were initiated based on allegations of illegal detention and assault by officers of the Central Excise Department. The Court found that the learned Magistrate had sufficient grounds to take cognizance of the complaint due to the multiple injuries sustained by the appellant. Consequently, the Supreme Court set aside the High Court's order and directed the Magistrate to expedite the criminal proceedings within six months.
