The Supreme Court in Union of India Vs. Arun Jyoti Kundu and Ors. (2007) 7 SCC 472 held that the Central Administrative Tribunal exceeded its jurisdiction by issuing directions regarding pay scales for typists, which were not recommended by the Fifth Pay Commission. The Court clarified that it is within the Government's discretion to accept or reject Pay Commission recommendations and that the decision to grant relief to certain typists was not discriminatory. Consequently, the Court set aside the High Court's order affirming the Tribunal's decision and dismissed the original applications before the Tribunal.
