The Supreme Court held that the Probation of Offenders Act, 1958 is not applicable to offences under the Prevention of Corruption Act, 1988, as these offences prescribe minimum sentences. Citing the precedent in State Through SP, New Delhi Versus Ratan lal Arora (2004) and State Represented by Inspector of Police, Pudukottai, T.N. Vs. A. Parthiban (2006), the Court affirmed that where a specific provision mandates a minimum sentence, relief under the Probation Act cannot be granted. The appeal was dismissed, and the appellant was ordered to surrender to serve his sentence.
