The Court emphasized that the TG Set's capacity of 3187.500 KW was not an energy-consuming apparatus for surcharge purposes. Consequently, the Court upheld the High Court's decision to quash the demand of Rs.49,04,127/- and directed the Board to issue a fresh order if necessary.
