The Supreme Court ruled that the Punjab State Electricity Board's demand for a surcharge on excess load was unjustified as the earlier High Court decision had already established that the stand-by load should not be included in the calculation. The Court emphasized that the TG Set's capacity of 3187.500 KW was not an energy-consuming apparatus for surcharge purposes. Consequently, the Court upheld the High Court's decision to quash the demand of Rs.49,04,127/- and directed the Board to issue a fresh order if necessary.
