Judgment text excerpt

The Supreme Court ruled that the amendment to the First Schedule of the Code of Criminal Procedure, 1973, made by the Madhya Pradesh Amendment Act of 2007, does not apply retrospectively to cases pending before the Judicial Magistrate, First Class, as of February 22, 2008. The Court held that such cases should continue to be tried by the Judicial Magistrate, First Class, and not by the Court of Sessions, thereby affirming the Full Bench decision of the Madhya Pradesh High Court. Consequently, the appeal was dismissed, upholding the lower courts' decisions regarding jurisdiction.
