Judgment text excerpt

The Supreme Court ruled that the respondents, who served as Assistant Professors for over two decades, are entitled to pension benefits under the University Pension Regulations, 1990, despite the University’s claim that their appointments were not regular as per Section 3(3) of the Rajasthan Universities’ Teachers and Officers (Selection for Appointment) Act, 1974. The Court emphasized that the respondents had contributed to the Pension Fund and met the conditions outlined in Regulations 22 and 23. The Court held that the respondents' long service and acceptance of contributions by the University warranted pension eligibility, thus reversing the University’s stance.
