The Supreme Court ruled that the respondent, having opted for the Contributory Provident Fund (C.P.F.) Scheme after voluntary retirement from the State of Rajasthan, is not entitled to pension benefits under the Pension Scheme. The Court emphasized that the option to choose between the Pension Scheme and C.P.F. Scheme was clearly communicated in Notification No.Pension/RAJAU/C/91/F-75/3668-768 dated 17th August, 1991, and the respondent's late option was accepted as a special case. The Court upheld the decision of the Rajasthan Agriculture University, confirming that the respondent's acceptance of the C.P.F. Scheme precludes any claim for pension benefits.
