The Supreme Court upheld the decision of the Orissa Administrative Tribunal, confirming that the re-initiation of departmental proceedings against Kanhu Charan Majhi was invalid as it contravened Rule 31 of the Orissa Civil Services (Classification, Control & Appeal) Rules, 1962. The Court held that once the proceedings were dropped on 16th October 1995, they could not be reviewed by the State Government on 4th September 2000. Consequently, the appeal by the State of Orissa was dismissed, affirming the Tribunal's ruling in favor of the respondent.
