The Supreme Court upheld the Allahabad High Court's orders directing the New Okhla Industrial Development Authority (NOIDA) to extend the benefits of the Government Order dated 22nd October 2002 to the Sarvpriya Sahakari Avas Samiti and Shivalik Sahakari Avas Samiti. The Court emphasized that the U.P. Industrial Area Development Act, 1976, specifically Clause (d) of Section 2, does not negate the rights of cooperative societies that had developed land prior to the declaration of industrial development areas. The Court affirmed that the actions of NOIDA in calling for the removal of unauthorized constructions were unjustified given the prior approvals granted to the societies.
