Judgment text excerpt

The Supreme Court upheld the conviction of the appellants under Sections 147, 149, 449, 436, 302, 395, and 396 of the Indian Penal Code, 1860, affirming the Delhi High Court's reversal of the earlier acquittal. The Court established that the presence of the appellants in a mob that attacked and set fire to a house, resulting in the deaths of two individuals, constituted a clear case of murder and rioting. The appeal was abated for appellant No. 4 due to his death during proceedings, but the convictions of the remaining appellants were maintained.
