Judgment text excerpt

The Supreme Court held that the Tamil Nadu Wakf Board is entitled to a declaration that the suit property is Wakf property under the Wakf Act, and that the legal representatives of the original defendant cannot claim rights under the Madras City Tenants' Protection Act, 1921 due to the 1994 Amendment Act which extinguished their rights. The Court emphasized that the absence of notice under Section 11 of the 1921 Act does not invalidate the suit as the property is Wakf property. The Court reversed the High Court's decision and restored the trial court's decree in favor of the Wakf Board.
