The Supreme Court held that the eviction of a tenant under Section 106 of the Transfer of Property Act and Section 13(6) of the West Bengal Premises Tenancy Act, 1956 requires proof of unauthorized alterations to the property. The Court found that the tenant had indeed made significant alterations without the landlord's consent, violating clauses (m), (o), and (p) of Section 108 of the Transfer of Property Act. Consequently, the Court overturned the High Court's decision, reinstating the eviction order against the tenant.
