Judgment text excerpt

The Supreme Court upheld the High Court's decision affirming the trial court's rejection of the appellant's discharge application in a corruption case under Section 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act, 1988. The Court found that there was prima facie evidence of the appellant's involvement in causing pecuniary loss to public sector undertakings by misusing his position as Union Railway Minister. The Court held that the trial court was justified in taking cognizance of the offence and that the investigation had adequately presented the necessary materials for sanctioning prosecution.
