The Supreme Court held that the High Court's directions for demarcation of surplus land under the Urban Land Ceiling Act, 1976, and the Madhya Pradesh Ceiling on Agricultural Holding Act, 1960, were improper as they disregarded the appellant's status as a 'bhumiswami' under the MP Land Revenue Code, 1959. The Court emphasized that the appellant's right to transfer land, as per the terms of the pattas, should not have been questioned without proper legal basis. Consequently, the Supreme Court set aside the High Court's order, restoring the appellant's rights over the land in question.
