The Supreme Court held that the Uttar Pradesh Avas Evam Vikas Parishad's decision to appoint the appellant as Chief Engineer on an officiating basis was valid under the Uttar Pradesh Avas Evam Vikas Prishad (Appointment and Conditions of Service of Chief Engineer) Regulations, 1990, specifically Regulations 8 and 11. The Court found that merit selection was appropriately considered, and the High Court's ruling that the senior most officer should be appointed in the absence of merit selection was not justified. The appeal was allowed, reinstating the Parishad's decision to appoint the appellant as Chief Engineer.
