The Supreme Court upheld the dismissal of Criminal Revision Petitions No.534 and 710 of 2011 challenging the Trial Court's refusal to recall prosecution witnesses under Sections 7 & 13(1) read with Section 13(1)(D) of the Prevention of Corruption Act, 1988. The Court found that the appellant's request for recall was made excessively late, over three years after the witnesses' initial examination, and that the Trial Court had rightly concluded that such a delay would prejudice the prosecution. The Court affirmed the High Court's view that there was no justification for recalling the witnesses given the age of the case and the procedural history.
