Judgment text excerpt

The Supreme Court held that Articles 66, 67 & 113 of the Limitation Act do not apply to rent proceedings in Himachal Pradesh, thereby establishing that the High Court erred in affirming the Appellate Authority's decision which set aside the Trial Court's eviction order. The Court restored the Trial Court's judgment, allowing the landlord's eviction petition based on subletting under Section 14 of the H.P. Urban Rent Control Act, 1987. The appeal was allowed with a directive for the respondents to vacate the premises within two years upon filing an undertaking.
