Judgment text excerpt

The Supreme Court upheld the detention order under Section 3 of the Tamil Nadu Prevention of Dangerous Activities of Bootleggers, Drug Offenders, Forest Offenders, Goondas, Immoral Traffic Offenders, Sand Offenders, Slum Grabbers and Video Pirates Act, 1982 (14 of 1982), affirming the High Court's dismissal of the Habeas Corpus Petition. The Court found that the Detaining Authority had sufficient grounds to classify the detenu as a 'goonda' based on his involvement in multiple criminal cases, despite the appellant's arguments regarding the nature of the offenses being mere law and order issues. The Court concluded that the detention was justified and did not violate the principles of preventive detention.
