The Supreme Court held that in cases involving third-party risks, as established in National Insurance Co. Ltd. Vs. Laxmi Narain Dhut, (2007) 3 SCC 700, the insurer is obligated to indemnify the amount and may recover it from the insured if necessary. The Court clarified that the principles from National Insurance Co. Ltd. Vs. Swaran Singh and Ors., (2004) 3 SCC 297 do not apply to cases outside of third-party risks. Consequently, the appeal was allowed, but the Court directed that any amount already paid to the respondents by the appellant shall not be recoverable.
