Judgment text excerpt

The Supreme Court allowed the appeal under Section 116A of the Representation of the People Act, 1951, overturning the Patna High Court's decision that had set aside Mangani Lal Mandal's election to the 15th Lok Sabha. The Court found that the High Court erred in concluding that the suppression of information regarding the candidate's first wife and dependents constituted a breach of Article 19(1)(a) and Section 100(1)(d)(iv) of the 1951 Act. The Court emphasized that the election petition did not sufficiently demonstrate that the election result was materially affected by the alleged non-disclosure, thus reinstating the election of the returned candidate.
