The Supreme Court held that the detention order under Section 3 of the Tamil Nadu Prevention of Dangerous Activities of Bootleggers, Drug Offenders, Forest Offenders, Goondas, Immoral Traffic Offenders, Sand Offenders, Slum Grabbers and Video Pirates Act, 1982 (14 of 1982) was not justified as the detaining authority failed to establish that the detenu's actions posed a threat to public order rather than merely a law and order issue. The Court emphasized the necessity for the authority to apply its mind to the facts and circumstances, noting that reliance on stale cases undermined the detention's validity. Consequently, the Court set aside the High Court's dismissal of the habeas corpus petition and ordered the release of the detenu.
