The Supreme Court, while considering a petition under Section 406 of the Code of Criminal Procedure, 1973, held that FIR No.163 dated 26/10/2006, which involved non-compoundable offences under Sections 147, 148, 149, 323, 307, 452, and 506 IPC, could be quashed due to a compromise between the parties. The Court noted that previous decisions allowing compounding of non-compoundable offences were doubted and referred to a larger bench, which ultimately upheld the possibility of quashing FIRs in light of settlements. The Court granted the petitioners' request for transfer of the case and quashing of the FIR based on the compromise deed submitted.
