The Supreme Court held that Section 23D of the High Court Judges (Salaries and Conditions of Service) Act, 1954 entitles retired Judges to medical facilities equivalent to those provided to retired Class-I officers of the Central Civil Services under the Central Government Health Scheme. The Court found that the Government of Maharashtra failed to comply with the High Court's directive to frame rules for medical treatment and reimbursement for retired Judges. Consequently, the Court allowed the appeals and set aside the impugned orders of the High Court, mandating the State Government to implement the necessary provisions for retired Judges' medical facilities.
