Judgment text excerpt

The Supreme Court upheld the conviction of the appellants under Section 8(1) read with Section 8(2) of the Kerala Abkari Act for possession of arrack, affirming the findings of both the trial court and the High Court. The Court found no grounds for interference with the conviction but considered the age and non-habitual nature of the offenders in relation to sentencing. Consequently, the Court maintained the High Court's modified sentence of 18 months rigorous imprisonment and a fine of Rs.1,00,000/- with a reduced default sentence of six months.
