Judgment text excerpt

The Supreme Court held that under Section 4(4) of the Workmen’s Compensation Act, the claimant must establish a causal connection between the employee's death and their employment. The Court found that the High Court erred in setting aside the Workmen’s Compensation Commissioner's award of Rs.2,20,280/- plus funeral charges, as the evidence indicated the deceased's death was linked to the stress of his employment as a truck driver. The appeal was allowed, reinstating the compensation awarded by the Commissioner.
