Judgment text excerpt

The Supreme Court upheld the lower court's decision granting specific performance of a contract under Section 10 of the Specific Relief Act, 1963, confirming that the appellant had proven the existence of a valid agreement for sale dated 18th April 1996 and had paid earnest money of Rs.39,000. The Court found that the respondent failed to substantiate claims of signing a blank stamp paper and that the appellant was ready and willing to perform his part of the contract. The appeal was dismissed, affirming the direction for the respondent to execute the sale deed by 31st August 1998.
