The Supreme Court held that the rules of reservation do not apply to the upgradation of posts under the Biennial Cadre Review (BCR) scheme as per the Circular dated 16.10.1990. The Court clarified that the BCR scheme is aimed at addressing stagnation and is not a promotion scheme, thus not invoking the provisions of reservation under Article 16 of the Constitution. The appeal by Bharat Sanchar Nigam Ltd. was dismissed, affirming the validity of the BCR scheme without the application of reservation rules.
