Judgment text excerpt

The Supreme Court held that the award under Section 11A of the Land Acquisition Act, 1894 must be made within two years from the declaration under Section 6, and any delay beyond this period results in the acquisition proceedings lapsing. The Court found that the High Court erred in considering the date of communication of the vacated stay order rather than the actual period of the stay itself. Consequently, the Court quashed the acquisition proceedings as the award was made beyond the statutory period, thereby upholding the appellants' claim.
